Mary is a specialist local government and resource management lawyer, fast-track approvals panel chair, and public authority investigator. Previously a partner at Tauranga firm Cooney Lees Morgan, she joined the independent bar in September 2025.
With over 25 years’ litigation, advisory and dispute resolution experience, Mary appears regularly in courts and tribunals throughout the country and has led several novel cases in the Supreme Court.
Mary advises private clients and local authorities on all aspects of resource management and local government law and policy, including subdivision and development, coastal processes and natural hazards, freshwater, Māori rights and interests, public works acquisitions and Reserves Act matters, consultation and engagement, governance and probity, local authority elections, privacy and information issues, and judicial review and declaration proceedings.
A past President of the Resource Management Law Association, Mary has a particular interest in resource management reform and was consulted by the Randerson Review Panel in relation to reform of the RMA. Mary regularly speaks at conferences on this subject. She sits on the New Zealand Law Society’s Environmental Law Committee.
Mary chairs expert panels under the Fast-Track Approvals Act 2024. She is the external designated officer for protected disclosure referrals for several local authorities under the Protected Disclosures (Protection of Whistleblowers) Act 2022 and investigates local authority Code of Conduct complaints.
Mary has a Masters of Commercial Law, specialising in competition and consumer law and intellectual property. She maintains an interest in those areas.
Mary is based in Mount Maunganui and accepts instructions throughout New Zealand.

Notable cases
Trustees of the Motiti Rohe Moana Trust v Bay of Plenty Regional Council [2024] NZSC 105 and [2024] NZCA 134 – Represented Bay of Plenty Regional Council in High Court and Court of Appeal judicial review and appeal proceedings relating to a plan change which sought to implement the National Policy Statement for Freshwater in relation to Māori rights and interests in freshwater. Leave to the Supreme Court was successfully opposed.
Whakatōhea Kotahitanga Waka (Edwards) v Te Kāhui and Whakatōhea Māori Trust Board and Ors [2024] NZSC 164 and [2025] NZSC 104 – Represented Crown Regional Holdings Limited and Ōpōtiki District Council in the first contested application under the Marine and Coastal Area (Takutai Moana) Act 2011, where the Supreme Court clarified (in two separate decisions) the test for Customary Marine Title, and customary rights in navigable rivers. Related proceedings in the High Court and Court of Appeal are ongoing.
Sustainable Otakiri Inc v Whakatāne District Council [2025] NZSC 158 – Represented Bay of Plenty Regional Council in Supreme Court proceedings involving novel issues regarding the “end use” effects of microplastics in the environment originating from a consent to take and use water for bottling, and tikanga effects associated with export of bottled water.
Whanarua Beachfront Property Owners Group Inc v Ōpōtiki District Council [2022] NZHC 2589 – Represented Ōpōtiki District Council in judicial review proceedings brought by beachfront bach owners unsuccessfully challenging the transfer of reserve land to Te Whānau ā Apanui to honour a Treaty settlement.
